Military Law

Michigan Criminal Defense Lawyers

Military law is a field of law relating to the governance of our armed forces. It has two areas:

Military Justice
Administrative Actions

each with its own set of rules and consequences.

The Uniform Code of Military Justice (UCMJ), originally enacted by Congress in 1951, governs military law. It applies to all four branches of the service and the United States Coast Guard, and all active duty military personnel are governed by it. The UCMJ includes offenses that are unique to the military as well as those covered by civilian law. We represent clients at all phases of the military justice system. We advise service members pending non-judicial punishment under Article 15 of the UCMJ, and we represent service members at all stages of military courts-martial. Examples of UCMJ offenses we have handled include:

Murder
AWOL/Desertion
Drug Distribution
Rape
Burglary
Aggravated Assault
Possession of Child Pornography
Absence Without Leave and Desertion
Fraternization
Anthrax Vaccination Refusal

Administrative actions usually are confined to personnel decisions, primarily the separation process. Separation decisions may be based on various forms of misconduct, including criminal conduct or conviction, medical disorder or unsatisfactory performance. Administrative actions may also involve promotion and non-selection issues, security clearances, reports of survey and correction of military records. We are experienced in representing service members in all aspects of administrative actions.
